                        | U.S. Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for two counts of Sexual Contact.
 Daniel Red Horse, Jr., age 41, was indicted by a federal grand jury on November 8, 2011.  He appeared before U.S. Magistrate Judge Mark A. Moreno on November 29, 2011, and pled not guilty to the indictment.  The maximum penalty upon conviction is 3 years' imprisonment.  The charges are merely accusations, and Red Horse is presumed innocent until and unless proven guilty. 
 The investigation is being conducted by Cheyenne River Sioux Tribe Law Enforcement.  Assistant U.S. Attorney Britt M. Haxton is prosecuting the case.  Red Horse was remanded to the custody of the U.S. Marshal.  A trial date has not yet been set.
